FAQs

Frequently Asked Questions:

What should I do if I have been hurt at work? The first thing to do is to be sure to report your injury to your employer and fill out all necessary paperwork, making sure to include all body parts involved in the injury. If the injury is serious, take photographs of the area, and include photos of anything which caused injury. Get the names, phone numbers and addresses of any witnesses to your injury.

What should I do if I have been involved in a collision? If involved in a collision where another is at fault, report the collision to the appropriate police agency (for example, if the collision occurred on a highway, report it to the California Highway Patrol). Get the name of the other driver and his or her driver's license number, license plate information, address, phone number and insurance information. When taken for medical care, be sure to report all parts of your body which were injured in the collision.

How long do I have to file a claim or lawsuit? The period of time in which to file a claim or lawsuit depends on many factors including, but not limited to the state in which you live, who injured you (e.g., a government entity, a doctor, a private individual, etc.), your own age (i.e., are you a minor), whether you were mentally incapacitated in the accident, etc. You should consult with an attorney as soon as possible after your injury, making sure that you consult with an attorney experienced in dealing with cases similar to yours to ensure that you do not violate the strict time limits involved in making a claim or filing a lawsuit. These time limits are often referred to as "statutes of limitation," or claim statutes.
