Several Legal Issues Raised In California Crane Accident

On Behalf of | Jul 14, 2014 | Workplace Accidents |

On Friday, May 30th two Bay Area men died in a tragic Yolo County crane accident.  According to SF Gate, the two men were working at a bridge construction site in Winters, California when the basket that was hoisting them came loose.  The basket fell nearly 80 feet, and crashed into timber covering a 30-foot hole below. The construction site accident remains under investigation.

Whenever work place accidents occur, injured persons and their families face many legal considerations and must make important decisions.   Consulting with an experienced San Francisco work site attorney is important to properly evaluate your options.

For example, in many situations California workers compensation laws require employers to pay certain benefits to injured employees, without assessing fault.  This may include sums for temporary and permanent disability, rehabilitation, medical care, and death benefits.  However, while workers compensation laws may provide recovery for many workplace injuries, these amounts are often limited and may not cover the totality of your expenses and damages.

Alternatively, in some instances workers and/or their families may be able to file a third party claim for negligence or wrongful death.  This includes construction accidents that occur as the result of third party liability – such as where a machine or other equipment used on the job is faulty or defective. In these instances the injured party or their family may be able to file a product liability lawsuit.  Further, it may also be appropriate to file a negligence lawsuit where a subcontractor or other third party’s careless or reckless conduct caused or contributed to the work place injury.  By filing a civil lawsuit, you and your family may seek recovery for all damages including medical expenses, lost wages and pain and suffering – which often reach amounts significantly higher than the sums provided through California’s workers compensation laws.

Consulting with an experienced San Francisco work site attorney is critical to determine the most appropriate option in your situation, and ensure you and your family obtain rightful compensation.   For more information, please contact the dedicated San Francisco construction site attorneys at Viadro Law, LLP for an immediate consultation.
