Here To Protect Your Future And Your Finances

Securing maximum compensation for those hurt on the job and elsewhere.

Workers’ Compensation Process

If you have been injured while on the job, you may be entitled to various types of benefits. These include medical treatment for the injury, temporary disability benefits to help you financially while you are recovering from the injury and permanent disability benefits, which are intended to compensate you for any permanent limitations you may have after your recovery period is over. If you cannot return to your old job because of the injury, you may be entitled to other benefits as well. Unfortunately, the workers’ compensation claims process is not always simple, and these benefits are not always easily obtained.

For example, there have been a number of changes to the California workers’ compensation process in recent years. These changes can make it more difficult for you to get the medical treatment you deserve, especially if you are attempting the process alone. Now more than ever, it takes a skilled attorney to ensure that you receive the full benefits to which you are entitled.

At Viadro Law, LLP, we guide our clients through the entire workers’ compensation process, from the initial filing to the final resolution. If you have suffered an injury in the workplace, please contact our Oakland law office.

The Workers’ Compensation Claims Process

After you have suffered an injury in the workplace, the first step in the claims process is to notify your employer. Whether you have been harmed in a workplace accident or suffered a cumulative stress injury, you should report your condition to your employer as soon as you become aware of it.

Your employer will give you a workers’ compensation claims form to fill out, as well as information about its workers’ compensation insurance carrier. The insurance carrier is then supposed to provide access to the medical treatment you require as well as temporary disability benefits paid at 2/3 of your average weekly wage. In nearly all cases, temporary disability benefits are limited to no more than two years. So, it is important to get the appropriate medical care during that period so that you can get back on your feet and back to work.

If doctors ultimately determine that you have suffered permanent disability, then you are also entitled to receive monetary compensation for that disability. But, workers’ compensation carriers try to limit the amount of these payments. It can be very important to have an attorney make sure that you are getting the appropriate amount of permanent disability for your injuries.
